Such occurrences are not isolated; they reflect a growing trend where reliance on AI-generated content is leading to inaccuracies that could compromise the integrity of legal proceedings.

AI’s Footprint in Legal Filings

Research led by Anand Shah from MIT has illuminated the startling rise in the volume of cases being filed in U.S. federal courts. The share of litigants representing themselves, known as pro se cases, has surged from 11% to an astonishing 18% since the advent of generative AI. This uptick suggests that AI is not merely a tool for experienced lawyers but is enabling individuals to pursue legal recourse they might have otherwise deemed too daunting.

Shah’s team analyzed a random sample of 1,600 court filings over eight years, revealing that the proportion of AI-generated text leapt from virtually zero to about 18% by early 2026. This dramatic increase highlights AI’s role in simplifying the formulation of legal arguments, especially in straightforward cases, while simultaneously raising alarms about the reliability of such submissions.

Strain on the Judicial System

The implications of this AI influx are particularly pressing for the lower courts, which are already grappling with increased workloads. Although current data indicates that case resolution times have not yet been adversely affected, the sheer volume of filings has soared by nearly 158%. Judges are finding themselves inundated with more documents to review, potentially jeopardizing the quality of judicial scrutiny.

As the number of filings escalates, the need for a structured approach to integrating AI into legal practices becomes paramount. Shah warns that unless boundaries are established, the legal system may soon reach a breaking point, where the pressure could impede the efficacy of legal proceedings.
